Our Terms of Business – Tenant Find Service

These Terms and Conditions (T&Cs) govern the agreement between Artful Lodger (“The Company”, “We”, “Us”) and the property owner (“The Client”, “You”) for the provision of our “Find a Tenant” service.

       1. Service Scope

    • 1.1. The Service: The “Find a Tenant” service includes marketing the property and *professional lead generation for your property. This typically concludes upon the tenant signing the Tenancy Agreement.

    • 1.2. Exclusions: This service does not include ongoing property management, rent collection, maintenance coordination, or legal advice regarding the tenancy.

       2. Client Obligations

    • 2.1. Authority: You confirm that you are the legal owner of the property or have the full legal authority to rent it out.

    • 2.2. Property Condition & Compliance: You must ensure the property meets all legal requirements for rental (e.g., safety checks, energy performance certificates (EPC), fire safety regulations, and landlord licensing where applicable) before the tenant(s) move in.

    • 2.3. Information Accuracy: You agree to provide Us with accurate and truthful information about the property and its condition.

    • 2.4. Speed of follow-up: You agree to contact the lead as soon as humanly possible within the same working day.
    • 2.5. Duplication Protocol: Given the precision of our qualification process, lead duplication is uncommon. Should you already have received the same prospect directly or via another third party, you are required to notify Artful Lodger immediately. This notification must be sent via email to sheffield@artfullodger.co.uk with the subject line: Duplication.
    • 2.6. Consequences of Non-Notification: Failure to provide the immediate required written email notification before the tenant’s reservation, tenancy signing, or occupancy will result in your continued liability for our full fee.

      3. Fees & Payment

    • 3.1. Our Scale of Fees: A single, one-off fee is payable by the client based on the monthly rental amount (pcm). Should the rental rate not exceed £700.00 pcm, the fee is £500.00. Where the rental rate exceeds £700.00 pcm, the fee payable is £750.00. For clarity, this fee structure operates on a tiered basis; for example, if a property’s rental is £1,000.00 pcm, the applicable fee is £750.00.

      • 3.2. When Fee is Payable: The fee becomes payable in full on the earliest of the following dates:

        > The date the Tenancy Agreement is signed by the tenant.
        > The date the Tenant moves into the property.

    • 3.3. Cancellation: If you withdraw the property from the market after we have introduced a tenant or tenants who subsequently sign a Tenancy Agreement and or pay a reservation fee, the full fee remains payable.

    • 3.4. Renewal/Extension: If the sourced tenant(s) enter into a new agreement or extend their current agreement with You directly, we do not charge an additional fee under this “Find a Tenant” agreement.

    • 3.5. Value-added Tax: VAT at the prevailing rate is applicable on all fees

       4. Tenancy Agreement

    • 4.1. Contract Responsibility: The Tenancy Agreement is a contract between You and the Tenant(s). We act solely as an intermediary to find the tenant.

    • 4.2. Final Decision: The final decision on the suitability of the tenant(s) and the terms of the Tenancy Agreement rests solely with the Client.

       5. Liability

    • 5.1. Tenant Suitability: We do not conduct standard referencing checks on prospective tenants. Therefore, we cannot guarantee a tenant’s future conduct, financial performance, or continued suitability. We accept no liability for any loss of rent or damage caused by the tenant.

    • 5.2. Your Compliance: We accept no liability for any failure by You to comply with your legal obligations as a landlord.

       6. Data Protection

    • 6.1. We will process personal data in accordance with relevant data protection laws (e.g., GDPR) for the purpose of carrying out this service.
